TRIPOWER VACATION RENTALS – GUEST RENTAL AGREEMENT – Terms and Conditions
To reserve a property in our rental program, the guest is required to make a deposit of 50% of the total balance, or pay in full for the reservation. When you make a reservation, an agreement will be prepared and emailed to you. You will be given 7 days to return the signed contract with your initial deposit, or payment in full. If we do not receive your signed agreement and deposit within the 7 day period, your reservation is automatically voided and canceled. For all reservations, 100% of the total balance will be due 60 days prior to arrival date. The total reservation balance includes property rent, a booking fee of $55.00, a damage waiver of $45.00, a cleaning fee, 6% state and 5% local taxes, and Trip Insurance if desired. Accepted online reservation payments are MasterCard or Visa.
Access to the property will be given unless full payment has been received and the Guest Agreement has been signed and returned to Tripower Vacation Rentals.
CLEANING: During your stay, it is requested you maintain the cleanliness of the property. When you leave, please do not leave dirty dishes, do not leave food in the refrigerator, and no dishes in dishwasher. During your stay you will be resposible for recycling and trash removal each week on assigned days (private homes only). Please return your property to a presentable condition, we will do thorough cleaning to prepare the unit for its next occupants. We appreciate your efforts in maintaining the cleanliness of the unit.
When you depart from your property please close all windows and secure/lock all exterior doors. ALL KEYS MUST BE RETURNED TO OUR OFFICE. IF NOT RETURNED, $75.00 PER KEY AND PASS WILL BE CHARGED TO YOUR CREDIT CARD.
DAMAGE WAIVER: TriPower Vacation Rentals collects a $45.00 Damage Waiver Fee from the guest which will cover up to $600.00 of unintentional and accidental damages to the vacation property. We will also require a valid Visa or Master Card number to be on file for damages considered by rental management to be of careless, reckless, or intentional nature, and/or for the dollar amount of accidental damages that exceed $600. Damages not covered by the $45.00 Damage Waiver Fee include, but are not limited to:
· Theft by an intruder with no police report.
· Missing items.
· Pets in a non-pet friendly property.
· Damage by pets in a pet friendly property that exceeds the pet deposit.
· Excessive cleaning required.
· Smoking in a nonsmoking unit.
· Extra and excessive utilities used by guest.
· Long distance calls, and/or ordered movies.
· Extra days rent, lockout fees, and keys or passes not returned.
· Fines due to unlawful behavior, or violation of a local ordinance.
The guest agrees that expenses and damages not covered by the Damage Waiver Fee will be charged to the credit card on file.
THE GUEST AGREEMENT MUST BE SIGNED AND BALANCE PAID IN FULL 60 DAYS PRIOR TO ARRIVAL. Payable in U.S. funds. Long term (4 weeks or more) reservations may have a special payment schedule. NO KEYS WILL BE GIVEN OUT UNLESS FULL PAYMENT HAS BEEN RECEIVED AND GUEST RENTAL AGREMENT HAS BEEN SIGNED. You may pay by Money Order, or Credit Cards – Master Card or Visa. Reservations made within the 60 days to arrival date, payment is due at time of reservation. PRICES SUBJECT TO CHANGE WITHOUT NOTICE. Reservations made prior to 60 days of arrival a deposit of 50% of total balance is due upon reservation, or pay in full for the reservation is due. After reservation is made you will be given 7 days to e-sign the Guest Rental Agreement. If we do not receive your signed agreement within the 7 day period, your reservation will be voided/canceled.
CANCELLATION POLICY: A $100 cancellation fee will be charged for all Cancellations. Written notice of cancellation must be received no less than sixty (60) days prior to your scheduled arrival date. If less than sixty (60) days, prepayment is subject to loss unless we are able to re-book the reservation. We recommend Trip Insurance that is available for this purpose.
SUBSTITUTIONS: We reserve the right to substitute comparable accommodations, should the confirmed unit become unavailable due to unforeseen circumstances. However, TriPower Vacation Rentals cannot guarantee the rental rate. Renter reserves the right to accept or refuse the substitute accommodations and rental rate.
RESTRICTIONS: SORRY, NO pets allowed (unless noted as a pet friendly property in writing from TriPower Vacation Rentals). Young adults between the ages of 18-24 must be accompanied by a chaperon over 35. No motor homes, boats and/or trailers are permitted in condominium parking lots. Absolutely no smoking is allowed in any property. There are heavy penalties and charges if there are signs of smoking in the property.
FURNISHINGS: All of our rental units are individually owned and are furnished and equipped for vacation living. Although TriPower Vacation Rentals administers minimum standards required for a unit to participate in our rental program, quality of furnishings and color schemes of the units may vary according to the individual owners taste. Neither TriPower Vacation Rentals nor the owner shall be responsible for providing additional furnishings or equipment not available presently in the unit.
TENNIS, SWIMMING POOL: TriPower Vacation Rentals cannot guarantee that swimming pools will be heated or at what temperature. That is under the control of the individual condominium associations and/or owners. Open/Close times and maintenance for swimming pool and tennis courts are at the discretion of the condominium association and owner of private homes. QUIET HOURS ARE 10 PM UNTIL 7 AM WITH NO EXCEPTIONS.
MAXIMUM OCCUPANCY: Occupancy is based on Fire Regulations and is indicated on the Reservation Confirmation (sent separately) and the occupancy limit cannot be exceeded without the consent of TriPower Vacation Rentals, as agent. If you exceed this limit at any time, we will be happy to find you additional accommodations.
MISCELLANEOUS CHARGES: A charge of $75.00 or more will be charged for EACH key lost or not returned to TriPower Vacation Rentals upon your departure. Check-out time is before 10:00 AM, unless later check-out times have been approved by TriPower Vacation Rentals. There will be a charge of one extra day for anyone checking out after the set check-out time. There will be a $50.00 charge for key delivery for each lock-out; $75.00 after 6:00 PM.
VIOLATION OF RULES: Renter understands that if he or any member of his/her party violates any of the conditions or agreements in this contract, agent may terminate this contract and enter premises by force or by statutory proceedings. (See City Ordinance) Please respect neighbors’ ingress and egress to their property and keep noise to a minimum. There is a town noise ordinance between 10:00 PM and 7:00 AM that must be observed.
LOSS OF PERSONAL PROPERTY: TriPower Vacation Rentals will not be held responsible for acts of theft or vandalism or other damage to the guests’ personal property.
IMPORTANT DISCLOSURES AND CONDITIONS: Renter understands that rented property may be for sale and may be shown with reasonable notice. Renter is advised that TriPower Vacation Rentals operates as an agent for the owner of the property and will be paid a commission by the owner. All deposits, prepaid rents and any other prepaid monies may be placed in an interest bearing account. Guest understands and agrees interest earned on these funds will accrue to the benefit of TriPower Vacation Rentals.
Use of Boat Docks and Boat Lifts: Not all boat docks and boat lifts are for tenant use. Please specify at time of reservation if a boat dock or lift is needed for use at the property in which you are renting. If not discussed and approved by TriPower beforehand (about the necessary use of the dock or boat lift) you will be asked to remove the vessel immediately. Tenants are not allowed to move, relocate or touch a boat parked on the property’s dock or boat lift without prior approval from TriPower. In some cases, there may be an extra charge for use of the boat dock and/or lift at the designated property.
Radon Gas: Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county public l unit.
IF FOR ANY REASON, IT BECOMES NECESSARY TO BRING SUIT AT LAW AGAINST GUEST CONCERNING ANY DEFAULT IN THE TERMS OF THIS CONFIRMATION THEN THE CONFIRMED GUEST SHALL BE LIABLE FOR ALL THE COST OF SUCH SUIT, INCLUDING REASONABLE ATTORNEY’S FEES INCURRED.
